Stag Brewery Planning Inquiry Case Management Conference Note: 20 September 2024

The Note of the CMC on 20 September 2024 has now been published.

The Inquiry is to be held on the following dates, at the venues set out below. It will not [emphasis added] be livestreamed, but the Council confirmed that the venues will have adequate accessibility facilities.

      1. The advocates were confirmed as Russell Harris KC for the appellant,
        and Matthew Reed KC for the Council of the London Borough of Richmond
        upon Thames. Three ‘Rule 6’ parties are confirmed, with advocates:
        Douglas Edwards KC for the Greater London Authority, Nick Grant for the
        Mortlake Brewery Community Group, and Philip Whyte for the West London
        River Group and Towpath Group.
        Joanna Vincent continues to act as the programme officer for the Inquiry.
        She is the point of contact for the parties and public. As an independent officer of the Inquiry, her primary role is to assist in ensuring that the Inquiry runs efficiently. All appeal documents and any other submissions to the Inquiry should be emailed to both Joanna Vincent and Holly Dutton, who is the Inspectorate’s case officer for these appeals.

      1. Main issues and how the evidence will be dealt with

      The main issues and the way in which they will be dealt with at the Inquiry
      remain as before. A draft timetable is available on the Inquiry website, and
      I will confirm the final schedule a couple of weeks before the Inquiry opens.
      Several months have passed since the submission of proofs of evidence. As
      such, I have invited the submission of new evidence but only where base
      conditions have changed to the extent that the existing proofs are out of
      date. The parties have agreed to collaborate on a note to define the areas
      in which new evidence will be submitted, to be agreed on or before Friday
      27 September. Broadly, I expect updated evidence on matters of economic
      viability, education, a limited heritage rebuttal, the housing delivery test
      update (and any associated recasting of housing figures), and the most
      recent planning policy position (based on the completion of the Council’s
      draft local plan examination, the expected forthcoming National Planning
      Policy update, and recently issued Written Ministerial Statements).

    Previously submitted proofs of evidence will be used for all other matters.
    New core documents should be added to the library only where they are
    necessary to accompany updated proofs of evidence. These limitations will
    ensure that all parties can largely rely on work that has already been
    undertaken and avoid having to prepare or review a significant amount of
    new information.

    1. One bound hard copy of any new or updated proofs of evidence (excluding
      lengthy appendices) and rebuttal proofs should be sent to Holly Dutton at
      the Inspectorate.
    2. I reconfirmed that other interested parties will be able to make oral
      submissions to the Inquiry or question witnesses at the conclusion of their
      cross-examination and understand that some interested parties have
      indicated that they wish to submit new written representations. Any such
      representations should be received one week prior to the submission of
      supplementary proofs of evidence. Joanna Vincent will contact those who
      have indicated that wish to submit additional evidence.
